57 <br />4. Contractor's Responsibility After Notice of Nonrenewal or Termination <br />(5 CCR 18302 and 18054) <br />a. After receiving notice of the CDSS's decision to terminate the contract or <br />to make no offer of continued funding, the contractor shall submit copies <br />to, or make available for copying by the CDSS, all of the following: <br />i. A current inventory of equipment purchased in whole or in part with <br />contract funds; <br />ii. The names, addresses and telephone numbers of all families served <br />by the contract, all staff members funded by the contract; and <br />iii. Monthly enrollment and attendance reports until the contract is actually <br />terminated or until the final month for which the contractor retains a <br />contract. C2AP, C3AP, CAPP, CMAP, and CFCC contractors shall <br />also submit the names, addresses and telephone numbers of all <br />providers of subsidized services under the contract. <br />b. The CDSS shall only be obligated to compensate the contractor for net <br />reimbursable program costs or earnings, whichever is less, in accordance <br />with this contract through the date of termination . There shall be no other <br />compensation to the contractor. The CDSS shall offset any monies the <br />contractor owes against any monies CDSS owes under this contract. <br />G. Independent Appeals (WIC 10392, 10393) <br />1. An independent appeal procedure shall be available to any contractor in any <br />of the following circumstances: <br />a. Termination of a contracting agency’s contract <br />b. Denial of more than four (4%) percent or twenty-five thousand dollars <br />($25,000), whichever is less, of the contact maximum reimbursable <br />amount. <br />c. Demand for remittance of an overpayment of more than more than four <br />(4%) percent or twenty-five thousand dollars ($25,000), whichever is less, <br />of the contact maximum reimbursable amount. <br />2. Before filing an appeal petition for an action taken pursuant to (b) or (c) of (1) <br />above, the contractor shall have submitted all previously required standard <br />monthly or quarterly reporting forms to the CDSS. <br />3. Such appeals shall be heard by independent hearing officers in accordance <br />with procedures established by the Office of Administrative Hearings (OAH) <br />as specified in California Code of Regulations, Title 1, Sections 1121 through <br />1126,
