purpose of establishing certainty for both City and owner in the development <br />process. <br />F. Because of the logistics, magnitude of the expenditure and considerable <br />lead time prerequisite to planning and developing the Project, Applicant has <br />proposed to enter into a development agreement concerning the Project <br />(DA No. 2025-01) to provide assurances that the Project can proceed <br />without disruption caused by a change in the City's planning policies and <br />requirements except as provided in the DA No. 2025-01, which assurance <br />will thereby reduce the actual or perceived risk of planning for and <br />proceeding with development of the Project. <br />G. On August 11, 2025, the Planning Commission of the City of Santa Ana <br />held a duly -noticed public hearing on the proposed Project and <br />recommended that the City Council approve an ordinance approving DA <br />No. 2025-01. <br />H. Entering into this DA No. 2025-01 would provide the City with extraordinary <br />and significant benefits that are of regional significance, relate to existing <br />deficiencies in public facilities, require the Property Owners to contribute a <br />greater percentage of benefits than would otherwise be required, and <br />represent benefits which would not otherwise be required as part of the <br />development process. <br />The Project and the use that the Applicant propose in connection with the <br />Project have been extensively reviewed and considered by the City Council, <br />and such proposed development and use have been found to <br />accommodate the City's recommendations and suggestions in order to <br />protect the public's interest to enhance the desirability of such proposed <br />development and use. The terms and conditions of this DA No. 2025-01 are <br />fair, just and reasonable, and the City Council has concluded that the pursuit <br />of the Project will serve the interests of the City. <br />Based on the entire record before the City Council and all written and oral <br />evidence presented, the City Council finds DA No. 2025-01 in the public's <br />interest and results in substantial community benefits because it meets and <br />facilitates the fulfillment of many of the City's adopted General Plan "Issues, <br />Goals and Policies" for each individual element, as further documented in <br />the Ordinance of the City Council approving AA No. 2025-01 to establish <br />The Village Santa Ana Specific Plan (SP-6) and approving the zone change <br />from SD-48 to SP-6. <br />Section 2. The City prepared a Draft Supplemental Environmental Impact <br />Report (Draft SEIR) that analyzed the Project's environmental impacts in accordance with <br />the California Environmental Quality Act (Public Resources Code, §§ 21000 et seq., <br />CEQA), the regulations promulgated thereunder (14 Cal. Code of Regulations, §§ 15000 <br />et seq., the CEQA Guidelines), and the City's Local CEQA Guidelines. The Draft SEIR <br />was made available for public review for 52 days between April 17, 2025 and June 9, <br />2025. The document was made available online at the City of Santa Ana website and <br />available for review at City Hall and the Southwest Senior Center in hard copy form.
