WHEREAS, no comments made in the public hearing conducted by City Council <br />and no additional information submitted to the City Council have produced substantial <br />new information requiring recirculation of the Final SEIR or additional environmental <br />review of the Project under Public Resources Code Section 21092.1 and State CEQA <br />Guidelines Section 15088.5; and <br />WHEREAS, all other legal prerequisites to the adoption of this Resolution have <br />occurred. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa <br />Ana as follows: <br />Section 1. The above recitals are true and incorporated herein by reference. <br />Section 2. The City Council hereby finds that it has been presented with the Final <br />SEIR, which it has reviewed and considered, and further finds that the Final SEIR is an <br />accurate and objective statement that has been completed in full compliance with CEQA <br />and the State CEQA Guidelines, and that the Final SEIR reflects the independent <br />judgment and analysis of the City, acting as lead agency for the Project. <br />Section 3. The City Council declares that no evidence of new significant impacts or <br />any new information of "substantial importance," as defined by State CEQA Guidelines <br />Section 15088.5, has been received by the City after circulation of the Final SEIR that <br />would require recirculation of the Final SEIR. <br />Section 4. The City Council hereby: <br />A. Certifies the Final SEIR based on the entirety of the record of proceedings. <br />B. Adopts the Findings of Fact and Statement of Overriding Considerations, <br />attached hereto and incorporated herein as Exhibit A, after balancing the <br />significant and unavoidable recreation impacts of the proposed Project <br />against the benefits of the proposed Project. <br />C. Adopts the MMRP attached hereto and incorporated herein as Exhibit B, <br />consistent with Public Resources Code Section 21081.6; makes <br />implementation of the mitigation measures in the MMRP a condition of <br />approval of the Project; and finds in the event of any inconsistencies <br />between the mitigation measures set forth herein and the MMRP, the <br />MMRP shall control. <br />D. Directs City staff to cause a Notice of Determination to be filed and posted <br />with the County of Orange Registrar-Recorder/County Clerk and the State <br />Clearinghouse within five working days of the City Council's final Project <br />approval. <br />Resolution No. 2025-XXX <br />Page 5 of 7 <br />
