4 NO ENVIRONMENTAL EFFECTS AND LESS THAN SIGNIFICANT <br />ENVIRONMENTAL EFFECTS WITHOUT MITIGATION MEASURES <br />Explanation of the Rationale: A records search conducted for the Project indicated a total of <br />three cultural resources are documented within the half -mile search radius of the Project site. <br />However, none of these resources are located within or adjacent to the Project area, and no built <br />environment resources within the project area were identified in the Built Environment Resource <br />Directory. Additionally, the existing South Coast Village was evaluated for listing on the California <br />Register of Historical Resources in accordance with Section 15064.5(a)(2)-(3) of the State CEQA <br />Guidelines, and is recommended ineligible for listing in the California Register. Therefore, the <br />Project would not cause a substantial adverse change in the significance of a historical resource <br />and no impact would occur. (Draft Supplemental EIR, pp. 4.2-13 — 4.2-14.) <br />Threshold C-3: The Project would not disturb any human remains, including those interred <br />outside of dedicated cemeteries. <br />Findings: The City finds that the Project would result in less than significant impacts to cultural <br />resources related to human remains. (Draft Supplemental EIR, pp. 4.2-16 — 4.2-17.) <br />Additionally, the City finds that the Project will implement the following regulatory requirement <br />(Draft Supplemental EIR, p. 4.2-5): <br />RR CUL-1: California Health and Safety Code Section 7050.5 requires that if human <br />remains are discovered within the proposed project site, disturbance of the site shall halt <br />and remain halted until the coroner has investigated the circumstances, manner, and <br />cause of any death, and the recommendations concerning the treatment and disposition <br />of the human remains have been made to the person responsible for the excavation, or to <br />his or her authorized representative. If the coroner determines that the remains are not <br />subject to his or her authority and if the coroner recognizes or has reason to believe the <br />human remains to be those of a Native American, he or she shall contact, by telephone <br />within 24 hours, the Native American Heritage Commission. <br />Explanation of the Rationale: Sensitivity for buried human remains would be low at the Project <br />site, as the Project site does not contain cemeteries or known burial grounds, and past <br />construction activities have disturbed the entire property. However, as the Project would require <br />excavations that are anticipated to disturb a large part of the Project site at varying depths up to <br />a maximum depth of 52 feet for the subsurface parking garage, there is potential to encounter <br />previously unknown human remains. In the event that human remains are discovered, the <br />remains would be treated in accordance with California Health and Safety Code Section 7050.5 <br />(RR CUL-1), State CEQA Guidelines Section 15064.5, and Public Resources Code Section <br />5097.98. Compliance with these regulations would ensure that impacts to human remains would <br />be less than significant.
