ADDITIONAL INSURED ENDORSEMENT This endorsement modifies insurance provided under the following: BUSINESS AUTO COVERAGE FORM MOTOR CARRIER COVERAGE FORM AUTO DEALERS COVERAGE FORM With respect to coverage provided by this endorsement,the provisions of the Coverage Form apply unless modified by the endorsement. This endorsement changes the policy effective on the inception date of the policy unless another date is indicated below: (The following needs to be completed only when this endorsement is issued subsequent to inception of the policy.) Named Insured Metropro Road Services,Inc Endorsement Effective Policy Number K2GP632444 SCHEDULE Name of Additional Insured Person(s)or Organization(s): The City of Santa Ana, its City Council, officers, officials, employees, agents, and volunteers A. Who Is An Insured is amended to include as an additional insured the person(s) or organization(s) shown in the Schedule above, but only with respect to liability for"bodily injury", "property damage", or"personal and advertising injury"caused, in whole or in part, by: 1. Your acts or omissions; or 2. The acts or omissions of those acting on your behalf; arising out of use of a covered"auto"in your business when such use is pursuant to a written contract or agreement between you and the additional insured. B. With respect to the insurance afforded to the additional insured, the following additional exclusions apply:This insurance does not apply to: 1. "Bodily injury"or"property damage"arising out of the maintenance of a covered"auto"by the additional insured; 2. "Bodily injury" or"property damage" for which the additional insured is obligated to pay damages by reason of the assumption of liability in a contract or agreement. This exclusion does not apply to liability for damages that the additional insured would have in the absence of the contract or agreement; and 3. Any"accident"which takes place after the contract or agreement between you and the additional insured is terminated. C. The insurance provided under this endorsement is excess over any other valid and collectible insurance available to the additional insured, unless you have agreed in a written contract or agreement for this insurance to apply on a primary or non-contributory basis.
