RESOLUTION NO. 2025-040 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF SANTA ANA AUTHORIZING THE CITY TO ENTER <br /> INTO A COOPERATIVE IMPLEMENTATION AGREEMENT <br /> WITH CALTRANS TO RECEIVE STORMWATER <br /> REIMBURSEMENT FUNDS TO CONSTRUCT THE SANTA <br /> ANA ZOO STORMWATER CAPTURE AND DIVERSION <br /> PROJECT <br /> WHEREAS, the City of Santa Ana (City) has adopted and implemented the <br /> Project identified as the Santa Ana Zoo Stormwater Capture and Diversion Project <br /> (Project). <br /> WHEREAS, the State Water Resources Control Board issued the Trash <br /> Provisions of the Water Quality Control Plan for Inland Surface Waters, Enclosed Bays, <br /> and Estuaries of California (Trash Provisions), which applies to both the City and the <br /> California Department of Transportation (Caltrans) as municipal separate storm sewer <br /> system (MS4) permittees. <br /> WHEREAS, the City and Caltrans are required to comply with the Trash <br /> Provisions by installing, operating, and maintaining full capture systems (or full capture <br /> system equivalency) for storm drains that capture runoff from significant trash <br /> generating areas or regulated priority land use areas. <br /> WHEREAS, the City and Caltrans are required to comply with Total Maximum <br /> Daily Load (TMDL) waste load allocations in their respective NPDES permits in the <br /> Newport Bay watershed. <br /> WHEREAS, the City's Project will capture and infiltrate runoff via dry wells and <br /> control trash via a State Water Board certified gross solid removal device from the <br /> contributing drainage basin area. <br /> WHEREAS, Caltrans owns property within the total contributing drainage basin <br /> area, and through hydraulic connectivity, receives compliance generation for multi- <br /> pollutant treatment removal attributed to Caltrans stormwater conveyed to the Project. <br /> WHEREAS, Caltrans and the City, pursuant to California Streets and Highways <br /> Code (SHC) Sections 114 and 130, will enter into a Cooperative Agreement for <br /> improvements to the State Highway System (SHS) as a watershed stakeholder within <br /> the City's jurisdiction. <br /> WHEREAS, now Caltrans has agreed to contribute an amount not to exceed <br /> $3,700,000 Dollars in reimbursement funds to the City to construct the Project, within <br /> i <br /> Resolution No. 2026-040 <br /> Page 1 of 3 <br />
