and the Juaneno Band of Mission Indians,Acjachemen Nation-Belardes determined tribal cultural <br /> resources may potentially be encountered during ground disturbing construction activities. The <br /> potential to encounter buried prehistoric archaeological sites exists for excavation in undisturbed <br /> soils. Therefore, GPU PEIR MM CUL-6 and Project-Specific MM TCR-1 through MM TCR-6 would <br /> be implemented to require Native American monitoring during any ground disturbing activities on <br /> the Project site and to avoid potential impacts to tribal cultural resources that may be unearthed <br /> from Project construction activities. Therefore, project impacts to tribal cultural resources would <br /> be less than significant with mitigation incorporated. <br /> Cumulative Impacts: The Project would not result in cumulative impacts concerning tribal cultural <br /> resources, with the implementation of mitigation. <br /> Findings: The City finds that changes or alterations have been required in, or incorporated into, <br /> the Project, which avoid or substantially lessen the significant environmental effect as identified <br /> in the Final Supplemental EIR. Specifically,the City finds that GPU PEIR MM CUL-6 and Project- <br /> Specific MM TCR-1 through MM TCR-6 (listed previously) shall be implemented to reduce <br /> potentially significant tribal cultural resource impacts resulting from the Project. Additionally, the <br /> City finds that the Project will implement regulatory requirements RR TCR-1 through RR CULA <br /> (listed above). (Draft Supplemental EIR, p. 4.14-4.) <br /> Explanation of the Rationale: The rationale and facts supporting the above finding are fully <br /> developed in Section 4.14, Tribal Cultural Resources, pages 4.14-14 through 4.14-15 of the Draft <br /> Supplemental EIR and in Chapter 3, Revisions to the Draft Supplemental EIR, of the Final <br /> Supplemental EIR. The following presents a summary of that rationale: <br /> As previously discussed, the Project site and vicinity are not known to contain tribal cultural <br /> resources. However, the excavation required for the proposed subsurface parking garage could <br /> encounter prehistoric archaeological sites containing tribal cultural resources. If tribal cultural <br /> resources are encountered during construction, the Project has the potential to contribute to <br /> cumulative impacts. However, the Project would implement GPU PEIR MM CUL-6 and Project- <br /> Specific MM TCR-1 through MM TCR-6, which would protect any discovered tribal cultural <br /> resources. Therefore, the Project's contribution to cumulative impacts on tribal cultural resources <br /> would not be cumulatively considerable and would be less than significant with mitigation <br /> incorporated. <br /> Resolution No. 2025-041 <br /> Page 87 of 140 <br />
