Defendants refused to provide copies of the unlawfully released <br /> 4 information and/or the list of names of the impacted employees. <br /> 5 <br /> 6 FIRST CAUSE OF ACTION <br /> 7 Against All Defendants <br /> 8 Violation of Penal Code 832 et seg. <br /> 9 27. Plaintiffs, Santa Ana Police Officers Association and Doe Officers, for a <br /> 10 First Cause of Action against Defendants Valentin, Carvalho, City of Santa Ana, Santa <br /> 11 Ana Police Department, the City Attorney's office for the City of Santa Ana; and DOES <br /> 12 I-X, inclusive, for a Preliminary Injunction, Permanent Injunction, Mandamus Relief <br /> 13 and/or other Extraordinary Relief for violation of Penal Code §832 et seq., reallege <br /> 14 paragraphs 1-26 above, and further allege: <br /> 15 28. Penal Code §832.7(a) provides "Except as provided in subdivision (b), the <br /> 16 personnel records of peace officers and custodial officers and records maintained by <br /> 17 any state or local agency pursuant to Section 832.5, or information obtained from these <br /> 18 1 records, are confidential and shall not be disclosed in any criminal or civil proceeding <br /> 19 except by discovery pursuant to Sections 1043 and 1046 of the Evidence Code. Said <br /> 20 records are also exempt from disclosure as public records under Government Code <br /> 21 §6250, et seq. <br /> 22 29. Penal Code §832.7(d) provides "Notwithstanding subdivisions (a) and (b), <br /> 23 a department or agency that employs peace or custodial officers may disseminate data <br /> 24 regarding the number, type, or disposition of complaints (sustained, not sustained, <br /> 25 exonerated, or unfounded) made against its officers if that information is in a form <br /> 26 which does not identify the individuals involved." <br /> 27 30, Penal Code §832.8 provides "As used in Section 832.7, the following <br /> 28 words or phrases have the following meanings: <br /> 7 <br /> COMPLAINT <br />
