Government Code §3304(a) provides that"No public safety officer shall be <br /> 2 subjected to punitive action, or denied promotion, or be threatened with any such <br /> 3 treatment, because of the lawful exercise of the rights granted under this chapter, or the <br /> 4 exercise of any rights under any existing administrative grievance procedure. <br /> 5 118. Government Code §3304(b) provides, in pertinent part, "No punitive action, <br /> 6 nor denial of promotion on grounds other than merit, shall be undertaken by any public <br /> 7 agency against any public safety officer who has successfully completed the <br /> 8 probationary period that may be required by his or her employing agency without <br /> 9 providing the public safety officer with an opportunity for administrative appeal." <br /> 10 119. Government Code §3304(d) (1) reads "Except as provided in this <br /> 11 subdivision and subdivision (g), no punitive action, nor denial of promotion on grounds <br /> 12 other than merit, shall be undertaken for any act, omission, or other allegation of <br /> 13 misconduct if the investigation of the allegation is not completed within one year of the <br /> 14 public agency's discovery by a person authorized to initiate an investigation of the <br /> 15 allegation of an act, omission, or other misconduct. This one-year limitation period shall <br /> 16 apply only if the act, omission, or other misconduct occurred on or after January 1, <br /> 17 1998. In the event that the public agency determines that discipline may be taken, it <br /> 18 shall complete its investigation and notify the public safety officer of its proposed <br /> 19 discipline by a Letter of Intent or Notice of Adverse Action articulating the discipline that <br /> 20 year, except as provided in paragraph (2). The public agency shall not be required to <br /> 21 impose the discipline within that one-year period." <br /> 22 120. Government Code §3305 provides that no public safety officer shall have <br /> 23 any comment adverse to his interest entered in his personnel file, or any other file used <br /> 24 for any personnel purposes by his employer, without the public safety officer having first <br /> 25 read and signed the instrument containing the adverse comment indicating he is aware <br /> 26 of such comment, except that such entry may be made if after reading such instrument <br /> 27 the public safety officer refuses to sign it.
