1 Violation of Labor Code §1101-1102.5 <br /> 2 156. Plaintiffs Santa Ana Police Officers Association and Gerry Serrano for a <br /> 3 Fourth Cause of Action against all Defendants for violation of provisions of the Labor <br /> 4 Code re-alleges paragraphs 1-95, above, and further allege as follows: <br /> 5 157, Labor Code section 1101 provides, in pertinent part, that no employer shall <br /> 6 make, adopt, or enforce any rule, regulation, or policy: (a) Forbidding or preventing <br /> 7 employees from engaging or participating in politics...(b) Controlling or directing, or <br /> 8 tending to control or direct the political activities or affiliations of employees. <br /> 9 158. Labor Code §1102 provides "No employer shall coerce or influence or <br /> 10 attempt to coerce or influence his employees through or by means of threat of <br /> 11 discharge or loss of employment to adopt or follow or refrain from adopting or following <br /> 12 any particular course or line of political action or political activity. <br /> 13 159. Labor Code §1102.5 provides that (a) An employer, or any person acting <br /> 14 on behalf of the employer, shall not make, adopt, or enforce any rule, regulation, or <br /> 15 policy preventing an employee from disclosing information to a government or law <br /> 16 enforcement agency, to a person with authority over the employee, or to another <br /> 17 employee who has authority to investigate, discover, or correct the violation or <br /> 18 noncompliance, or from providing information to, or testifying before, any public body <br /> 19 conducting an investigation, hearing, or inquiry, if the employee has reasonable cause <br /> 20 to believe that the information discloses a violation of state or federal statute, or a <br /> 21 violation of or noncompliance with a local, state, or federal rule or regulation, regardless <br /> 22 of whether disclosing the information is part of the employee's job duties. (b)An <br /> 23 employer, or any person acting on behalf of the employer, shall not retaliate against an <br /> 24 employee for disclosing information, or because the employer believes that the <br /> 25 employee disclosed or may disclose information, to a government or law enforcement <br /> 26 agency, to a person with authority over the employee or another employee who has the <br /> 27 authority to investigate, discover, or correct the violation or noncompliance, or for <br /> 28 providing information to, or testifying before, any public body conducting an <br /> 35 <br /> COMPLAINT <br />
