A. An employee must first attempt to resolve the <br /> grievance on an informal basis through discussion with his or her <br /> immediate supervisor without undue delay, but in no case, beyond a <br /> period of five (5) working days after the occurrence of the alleged <br /> incident giving rise to the grievance, or when the grievant knew or <br /> should have reasonably become aware of the facts giving rise to the <br /> grievance. <br /> B. The supervisor will respond to the grievance within <br /> five (5) working days of receiving the grievance . <br /> C. If the grievance is not resolved at the immediate <br /> supervisor level, the employee within five (5) working days of the <br /> supervisor' s response will attempt to resolve the grievance on an <br /> informal basis through discussion with his or her Section <br /> Commander. The Section Commander will respond to the grievance <br /> within three (3) working days of receiving the employee grievance . <br /> D. Every effort shall be made to find an acceptable <br /> solution to the grievance through this informal process . <br /> E. In order that this informal process may be responsive, <br /> all parties involved shall expedite this process . If, within <br /> thirteen (13) working days, a mutually acceptable solution has not <br /> been reached at the informal level , the employee shall then set <br /> forth the grievance in writing, indicate the nature of the action <br /> desired, sign it, and submit it in duplicate to his or her <br /> immediate supervisor. At this point, the grievance review process <br /> becomes formal . Should the grievant fail to file a written <br /> grievance, and in the manner specified above, within ten (10) <br /> working days after discussing the grievance with his or her Section <br /> Commander, the grievance shall be barred and waived. <br /> Section 3 . Formal Process . <br /> A. If the grievance is not resolved through the informal <br /> process, and a written grievance is filed within the time limits <br /> set forth above, the grievant' s immediate supervisor and Section <br /> Commander will add their comments and any justification they <br /> consider proper, sign it, and forward it to their Division <br /> Commander without undue delay, or in no case, more than three (3) <br /> working days . <br /> B. The Division Commander, after study of the case, shall <br /> attach his or her decision and reasons therefore, and return them <br /> to the employee within three (3 ) working days after receipt of the <br /> written grievance . <br /> C. If no satisfactory settlement has been reached at the <br /> division level , the employee may, within six (6) working days after <br /> receipt of the Division Commander' s decision and reason (s) <br /> therefore, carry the matter to the Chief of Police .
