Section 1 . Prohibited Conduct . <br /> A. The Association, its officers, agents, <br /> representatives, and/or members agree that during the term of this <br /> Agreement, they will not cause or condone any unlawful strike, <br /> walkout, slowdown, sick-out or any other unlawful job action by <br /> withholding or refusing to perform services . <br /> B . Any employee who participates in any conduct <br /> prohibited in Subsection A above shall be subject to suspension, <br /> demotion or dismissal by the appointing authority. <br /> C. In addition to any other lawful remedies or <br /> disciplinary actions available to the City, if the Association <br /> fails, in good faith, to perform all responsibilities listed below <br /> in Section 2, Association Responsibility, the City may suspend any <br /> and all rights and privileges, accorded to the Association in this <br /> Agreement, including but not limited to suspension of the Grievance <br /> Review Procedure and dues deduction. <br /> Section 2 . Association Responsibility. In the event that the <br /> Association, its officers, agents, representatives, or members <br /> engage in any of the conduct prohibited in Section lA of this <br /> Article, Prohibited Conduct, the Association shall immediately <br /> instruct any persons engaging in such conduct that their conduct is <br /> in violation of this Agreement and unlawful, and they must <br /> immediately cease engaging in conduct prohibited in said Section <br /> 1A, and return to work. <br /> ARTICLE XXII - LAYOFFS <br /> The City shall follow and adhere to Santa Ana Municipal Code <br /> Section 9-119 regarding layoffs . Section 9-119 of the Santa Ana <br /> Municipal Code states : <br /> "All layoffs within the competitive service occasioned by the <br /> abolishment of a position, the combination of duties of two (2) or <br /> more positions, or the reduction in number of employees in a given <br /> class shall be governed by seniority in service and performance. <br /> Reemployment shall be in reverse order of layoff . " <br /> ARTICLE XXIII - MISCELLANEOUS PROVISIONS <br /> Section 1 . Physical Standards for Police Officers . The City <br /> agrees to formulate a Labor/Management committee to study and <br /> recommend physical standards for Police Officers and to develop <br /> incentives for the maintenance of required physical standards . <br /> Section 2 . Drug Testing. The City and the Association agree to <br /> have a "reopener" provisions to meet and confer regarding the <br /> 40 <br />
