writing, indicate the nature of the action desired, sign it, and submit <br /> it in duplicate to his or her immediate supervisor. At this point, the <br /> grievance review process becomes formal. Should the grievant fail to <br /> file a written grievance, and in the manner specified above, within ten <br /> (10) working days after first discussing the grievance with his or her <br /> immediate supervisor, the grievance shall be barred and waived. <br /> Section 3. Formal Process. <br /> A. If the grievance is not resolved through the informal <br /> process, and a written grievance is filed within the time limits set <br /> forth above, the grievant's immediate supervisor shall add his or her <br /> comments and any justification he or she considers proper, sign it, and <br /> forward it to his or her Division Commander without undue delay, or in no <br /> case, more than three (3) working days. <br /> B. The Division Commander, after study of the case, shall <br /> attach his decision and reasons therefore, and return them to the <br /> employee within three (3) working days after receipt of the written <br /> grievance. <br /> C. If no satisfactory settlement has been reached at the <br /> division level, the employee may, within six (6) working days after <br /> receipt of the Division Commander's decision and reason(s) therefore, <br /> carry the matter to the Chief of Police. To do so, the employee shall <br /> describe on separate correspondence, the reason why he is not satisfied, <br /> and shall submit this, with the original form through his superior <br /> officer and Division Commander to the Chief of Police. Failure of the <br /> grievant to take this action will constitute a waiver and bar to the <br /> grievance, and the grievance will be considered settled on the basis of <br /> the Division Commander's response. <br /> D. If the grievant files a written grievance to the Chief of <br /> Police in the manner and within the time limits specified in "C" above, <br /> then a conference shall be held at the request of the employee or the <br /> Chief of Police. <br /> E. The Chief of Police shall inform the employee of his <br /> action within ten (10) working days after receipt of the request for <br /> settlement. The original of the grievance form and the Chief's decision <br /> shall be filed in the Personnel Records of the department. <br /> F. If no satisfactory settlement has been reached at the <br /> departmental level, the employee may, within six (6) working days after <br /> being informed by the Chief of Police of his decision on the matter, and <br /> the reasons thereof, submit the grievances in writing to the City <br /> Manager, or his duly authorized representative, for determination. <br /> Failure of the grievant to take this action will constitute a waiver and <br /> bar to the grievance, and the grievance will be considered settled on the <br /> basis of the Chief of Police's response. <br /> -32- <br />
