grievance, and in the manner specified above, within ten ( 10 ) <br /> working days after first discussing the grievance with his or her <br /> immediate supervisor, the grievance shall be barred and waived. <br /> Section 3 . Formal Process. <br /> A. If the grievance is not resolved through the informal <br /> process , and a written grievance is filed within the time limits <br /> set forth above, the grievant' s immediate supervisor shall add <br /> his or her comments and any justification he or she considers <br /> proper, sign it, and foward it to his or her Division Commander <br /> without undue delay, or in no case, more than three (3 ) working <br /> days. <br /> B. The Division Commander, after study of the case, <br /> shall attach his decision and reasons therefore , and return them <br /> to the employee within three (3) working days after receipt of <br /> the written grievance. <br /> C. If no satisfactory settlement has been reached at <br /> the division level, the employee may, within six ( 6) working days <br /> after receipt of the Division Commander's decision and reason( s) <br /> therefore, carry the matter to the Chief of Police. To do so, <br /> the employee shall describe on separate correspondence, the reason <br /> why he is not satisfied , and shall submit this, with the original <br /> form through his superior officer and Division Commander to the <br /> Chief of Police. Failure of the grievant to take this action <br /> will constitute a waiver and bar to the the grievance , and the <br /> grievance will be considered settled on the basis of the Division <br /> Commander' s response. <br /> D. If the grievant files a written grivance to the <br /> Chief of Police in the manner and within the time limits specified <br /> in "C" above, then a conference shall be held at the request of <br /> the employee of the Chief of Police. <br /> F. The Chief of Police shall inform the employee of <br /> his action within ten (10 ) working days after receipt of the <br /> request of the settlement. The original of the grievance form <br /> and the Chief' s decision shall be filed in the Personnel Records <br /> of the department. <br /> F. If no satisfactory settlement has been reached at <br /> the departmental level, the employee may, within six (6 ) working <br /> days after being informed by the Chief of Police of his decision <br /> on the matter, and the reasons thereof, submit the grievances in <br /> writing to the City Manager, or his duly authorized representative, <br /> for determination. Failure of the grievant to take this action <br /> will constitute a waiver and bar to the grievance, and the griev- <br /> ance will be considered settled on the basis of the Chief of <br /> Police' s response. <br /> The City Manager, after a careful review, shall render <br /> a final decision on the merits of the grievance , in writing, and <br /> -32- <br />
