MINUTES: City Attorney Sonia Carvalho responded to comments alleging violations of <br />the Brown Act and the California Public Records Act. She reminded the public that the <br />Brown Act applies to elected officials, not City staff, and stated that the City has not <br />violated the Brown Act and there is no evidence a majority of the City Council has met <br />to discuss the soccer field usage or made any decision regarding soccer field usage. <br />She stated the City has received a public record request and staff has responded <br />accordingly, explaining under the California Records Act, records may be withheld if <br />they fall within the exemptions. She announced the officerinvolved shootings mentioned <br />during the public comments are being investigated by the Orange County District <br />Attorney's Office and California Attorney General's Office, and stated the City has not <br />released a statement announcing its position on these incidents. <br />PUBLIC HEARING AGENDA ITEM NO. 28 MOVED OUT OF ORDER <br />PUBLIC HEARING <br />MINUTES: At 8.05 P.M., Public Hearing Item No. 28 was considered. <br />28. Adopt a resolution: (1) certifying the Final Supplemental Environmental Impact <br />Report No. 2025-01 (SCH No. 2020029087) for the Project; (2) adopting <br />Environmental Findings of Fact and a Statement of Overriding Considerations <br />for the Project; (3) adopting a Mitigation Monitoring and Reporting Program for <br />the Project; and (4) approving the Project; <br />RESOLUTION NO. 2025-041 entitled A RESOLUTION OF THE CITY <br />COUNCIL OF THE CITY OF SANTA ANA: (1) CERTIFYING THE FINAL <br />SUPPLEMENTAL ENVIRONMENTAL IMPACT REPORT FOR THE VILLAGE <br />SANTA ANA SPECIFIC PLAN PROJECT (SCH NO. 2020029087); (2) <br />ADOPTING ENVIRONMENTAL FINDINGS OF FACT AND A STATEMENT OF <br />OVERRIDING CONSIDERATIONS FOR THE PROJECT PURSUANT TO THE <br />CALIFORNIA ENVIRONMENTAL QUALITY ACT; AND (3) ADOPTING THE <br />MITIGATION MONITORING AND REPORTING PROGRAM <br />2.
