vacation time . <br /> Section 5 . Excess Usage . If vacation time off is used in <br /> excess of that available, such excess vacation time off will be, <br /> first, deducted from any available compensatory time off accrual ; <br /> finally, deducted from the next scheduled wage or salary payment . <br /> Section 6 . Time Off Bank. An Employee Time Off Bank exists <br /> for each employee in the unit . Time off will be computed on an <br /> annual basis and will be composed of allowable vacation and <br /> holidays based on existing policies . The time off from this bank <br /> may be taken in increments as small as one half (1/2) hour, with <br /> fractional usage rounded upward to the next higher multiple of one <br /> half (1/2) hour. <br /> Each affected employee shall be afforded the opportunity to <br /> submit time off selection (s) and the Chief of Police or his <br /> designee shall make every reasonable effort to accommodate the <br /> employee' s preference (s) . The time at which an employee shall take <br /> his or her leave time shall be determined by the Chief of Police, <br /> with due regard for the wishes of the employee and particular <br /> regard for the needs of the service . <br /> NOTE: All other policies and procedures described in Article IX <br /> "Holiday" and Article X "Vacation" will apply to the Time Off Bank. <br /> However, no employee will be allowed to carry a negative balance in <br /> the Time Off Bank. <br /> ARTICLE XI - OTHER LEAVES OF ABSENCE <br /> Section 1 . Sick Leave . <br /> A. Definition. Except as otherwise provided below, sick <br /> leave shall be deemed to mean absence from duty of an employee <br /> because of illness or injury that prevents the employee from <br /> performing the duties of his or her position, and shall be deemed <br /> to include time in quarantine resulting from exposure to a <br /> contagious disease . <br /> All "safety member" employees hired after July 1, 1981, <br /> and all persons employed as "safety members" by the City as of July <br /> 1, 1981, with five years of service or less shall not be entitled <br /> to use sick leave during periods of absence due to industrial <br /> illness or injury or to extend any leave of absence due to <br /> industrial illness or injury which leave is compensable under Labor <br /> Code Section 4850 ; provided that when said employees working for <br /> the City as of July 1, 1981, who then have five (5) years of <br /> continuous service with the City, they shall be able to use such <br /> leave during such absences in the same manner and to the same <br /> extent as persons employed as "safety members" by the City as of <br /> 27 <br />
