to report for duty. When the absence is more than <br /> three (3) consecutive working days, the employee <br /> must present to the Police Chief a physician' s <br /> certificate stating the cause of illness and that, <br /> in the physician' s opinion, the employee could not <br /> report to work because of such illness or injury <br /> and that the employee is sufficiently recovered to <br /> safely return to work. Such certificate shall be <br /> transmitted to the chief personnel officer with the <br /> report of the return of the employee to work. <br /> A physician' s certificate or other satisfactory <br /> written evidence of actual illness or injury may be <br /> required after an absence of any duration of less <br /> than three (3) days . <br /> H. Denial . No employee shall be entitled to sick <br /> leave with pay while absent from duty because of <br /> sickness or injury purposely self-inflicted or <br /> caused by willful misconduct; or sickness or <br /> disability sustained while engaged in employment <br /> other than employment by the City, for monetary <br /> gain or other compensation, or by reason of <br /> engaging in business or activity for monetary gain <br /> or other compensation. <br /> I . Excess Usage . If sick leave is used in excess of <br /> that due and available to an employee, such excess <br /> sick leave, will first, be deducted from any <br /> available compensatory time off benefit; second, <br /> from any available vacation leave benefit ; finally, <br /> deducted from the next scheduled wage or salary <br /> payment . <br /> J. Personal Necessity Leave . Each employee shall be <br /> afforded the opportunity to use up to three (3) <br /> days of sick leave benefits per calendar year (on a <br /> non-cumulative basis) for "personal necessity <br /> leave, " which circumstances shall include serious <br /> accidents or illnesses to members of the employee' s <br /> immediate family, childbirth, imminent danger to <br /> the employee' s home or other valuable property, or <br /> the existence of external circumstances beyond the <br /> employee' s control making it impractical for <br /> him/her to report for duty. For purposes of this <br /> section only, a "day" shall be defined as the <br /> number of hours of work that an employee is <br /> required to work according to his/her specific <br /> workday schedule . <br /> 38 <br />
