of Santa Ana <br />Section 3: Legal A <br />Section 3: Legal Authority <br />Section 3 of this SSMP addresses the requirements included in Attachment D-3 of <br />the Order. The requirements state: <br />Legal Authority: The Plan must include copies or an electronic link to the <br />Enrollee's current sewer system use ordinances, service agreements, and/or other <br />legally binding procedures to demonstrate the Enrollee possesses the necessary <br />legal authority to: <br />(a) Prevent illicit discharges into its sanitary sewer system (examples may include <br />infiltration/inflow (III), storm water, chemical dumping, unauthorized debris, <br />cut roots, fats, oils and grease, etc.); <br />(b) Collaborate with storm sewer agencies to coordinate emergency spill <br />responses, ensure access to storm sewer systems during spill events, and <br />prevent unintentional cross connections of sanitary sewer infrastructure to <br />storm sewer infrastructure; <br />(c) Require that sewers and connections be properly designed and constructed, <br />(d) Ensure access for maintenance, inspection, or repairs for portions of the lateral <br />owned or maintained by the Enrollee; <br />(e) Enforce any violation of its sewer ordinances, service agreements, or other <br />legally binding procedures; and <br />(f) Obtain easement accessibility agreements for locations requiring sewer system <br />operations and maintenance, as applicable. <br />The City is regulated by several agencies of the United States Government and the State of California, pursuant <br />to the provisions of Federal and State Law. Key Federal and State requirements: <br />1) Federal Water Pollution Control Act, commonly known as the Clean Water Act (33 U.S.C. Section 1251 <br />et seq); <br />2) California Porter Cologne Water Quality Act (California Water Code section 13000 et seq.); <br />3) California Health & Safety Code sections 25100 to 25250; <br />4) Resource Conservation and Recovery Act of 1976 (42 U.S.C. Section 6901 et seq.); and <br />5) California Government Code, Sections 54739-54740. <br />These laws provide the City the authority to regulate and/or prohibit, by the adoption of an ordinance, and by <br />issuance of control mechanisms, the discharge of any waste, directly or indirectly, to the City sewerage facilities. <br />Said authority includes the right to establish limits, conditions, and prohibitions; to establish flow rates or <br />prohibit flows discharged to the City sewerage facilities; to require the development of compliance schedules <br />for the installation of equipment systems and materials by all users; and to take all actions necessary to enforce <br />its authority, whether within or outside the City boundaries, including those users that are tributary to the City <br />or within areas for which the City has contracted to provide sewerage services. <br />2025 3-2 <br />
