STATEWIDE SANITARY SEWER SYSTEMS GENERAL ORDER <br />4.3. Discharge of Sewage Creating a Nuisance <br />Any discharge from a sanitary sewer system that creates a nuisance or condition of <br />pollution as defined in Water Code section 13050(m) is prohibited. <br />5. SPECIFICATIONS <br />5.1. Designation of a Legally Responsible Official <br />The Enrollee shall designate a Legally Responsible Official that has authority to ensure <br />the enrolled sanitary sewer system(s) complies with this Order, and is authorized to <br />serve as a duly authorized representative. The Legally Responsible Official must have <br />responsibility over management of the Enrollee's entire sanitary sewer system, and <br />must be authorized to make managerial decisions that govern the operation of the <br />sanitary sewer system, including having the explicit or implicit duty of making major <br />capital improvement recommendations to ensure long-term environmental compliance. <br />The Legally Responsible Official must have or have direct authority over individuals <br />that: <br />• Possess a recognized degree or certificate related to operations and maintenance of <br />sanitary sewer systems, and/or <br />Have professional training and experience related to the management of sanitary <br />sewer systems, demonstrated through extensive knowledge, training and <br />experience. <br />For example, a sewer system superintendent or manager, an operations manager, a <br />public utilities manager or director, or a district engineer may be designated as a Legally <br />Responsible Official. <br />The Legally Responsible Official shall complete the electronic CIWQS "User <br />Registration" form (https://ciwgs.waterboards.ca.gov/ciwqs/newUser.jsp). A Legally <br />Responsible Official that represents multiple enrolled systems shall complete the <br />electronic CIWQS "User Registration" form for each system. <br />The Enrollee shall submit any change to its Legally Responsible Official, and/or change <br />in contact information, to the State Water Board within 30 calendar days of the change <br />by emailing ciwgs waterboards.ca.gov and copying the appropriate Regional Water <br />Board as provided in Attachment F (Regional Water Quality Control Board Contact <br />Information) of this General Order. <br />5.2. Sewer System Management Plan Development and Implementation <br />To facilitate adequate local funding and management of its sanitary sewer system(s), <br />the Enrollee shall develop and implement an updated Sewer System Management Plan. <br />The scale and complexity of the Sewer System Management Plan, and specific <br />elements of the Plan, must match the size, scale and complexity of the Enrollee's <br />sanitary sewer system(s). The Sewer System Management Plan must address, at <br />minimum, the required Plan elements in Attachment D (Sewer System Management <br />Plan — Required Elements) of this General Order. To be effective, the Sewer System <br />Management Plan must include procedures for the management, operation, and <br />maintenance of the sanitary sewer system(s).
