Debarment Subrecipient shall execute and abide by the Certification Regarding Debarment, Suspension, Ineligibility and Voluntary Exclusion Lower Tier Covered Transactions, attached hereto and incorporated herein by this reference,and by so doing declares that it is not debarred or suspended or otherwise excluded from or ineligible for participation in Federal/State assistance programs in accordance with 29 C.F.R. Part 98. 2. Lobbying Certification A. Subrecipient shall execute and abide by the terms of the"Certification Regarding Lobbying," which is incorporated herein by this reference. Subrecipient shall complete and immediately forward to the County's Project Manager the Disclosure of Lobbying Activities,a copy of which is attached hereto and incorporated herein by this reference, if Subrecipient,or any person, firm or corporation acting on Subrecipient's behalf,engaged or engages in lobbying any federal office, employee, elected official or agency with respect to this Contract or funds to be received by Subrecipient pursuant to this Contract. B. Subrecipient agrees that the funds provided herein shall not be used to promote,directly or indirectly,any political party,political candidate or political activity,except as permitted by law. C. Subrecipient shall be in compliance with the Byrd Anti-Lobbying Amendment(31 U.S.C. 1352 and 29 CFR Part 93). 3. Fraud Subrecipient shall immediately report to the County's Project Manager, in writing,all suspected,alleged, or known instances and facts concerning possible fraud, abuse or criminal activity by either Subrecipient or its Subcontractor(s)under this Contract. Subrecipient shall inform staff and the general public of how to report fraud,waste or abuse through appropriate postings of incident reporting notice.The County's Anti-Fraud Program can be accessed https://www.ocgov.com/how-do-i/report/fraud-waste-abuse. Subrecipient shall maintain records, documents,or other evidence of fraud and abuse until otherwise notified by County. 4. Fiscal Appropriations This Contract is subject to and contingent upon available local,state,and/or federal funds and applicable budgetary appropriations being approved by the County of Orange Board of Supervisors for each fiscal year during the term of this Contract. If such appropriations are not approved,the Contract will be terminated,without penalty to the County. 5. Fiscal Accountability A. Subrecipient shall establish and maintain a sound financial management system,based upon generally accepted accounting principles.
