connection with this federal contract, grant, loan, or cooperative <br />agreemerf, the undersigned shall complete and submit Standard Form-LLL, <br />"Disclosure Form to Report Lobbying", in accordance with its instructions. <br />(c) The Applicant shall require that the language of this certification be included in <br />the award documents for all subawards at all tiers (including subcontracts, <br />subgrants, and contracts under grants, loans, and cooperative agreements) <br />and that all subrecipients shall certify and disclose accordingly. <br />The Applicant will also comply with provisions of the Hatch Act (5 u.s.c. §§ 1501- <br />1508 and §§ 7324-7328) which limit the political activities of employees whose <br />principal employment activities are funded in whole or in part with federal funds. <br />Finally, the Applicant agrees that federal funds will not be used, directly or indirectly, <br />to support the enactment, repeal, modification or adoption of any law, regulation, <br />or policy without the express written approval from the California Governor's Office <br />of Emergency Services (Cal OES) or the federal awarding agency. <br />4. Debarment and Suspension <br />As required by Executive Orders l 2549 and 12689, and 2 C.F.R. § 200.214 and <br />codified in 2 C.F.R. Part l 80, Debarmenf and Suspension, the Applicant will provide <br />protection against waste, fraud, and abuse by debarring or suspending those <br />persons deemed irresponsible in their dealings with the federal government. The <br />Applicarf certifies that it and its subrecipien+s: <br />(Cl) Are not presently debarred, suspended, proposed for debarment, declared <br />ineligible, or voluntarily excluded from covered transactions by any federal <br />depar+merf or agency: <br />(b) Have not within a three-year period preceding this application been <br />convicted of or had a civil judgment rendered against them for commission <br />of fraud or a criminal offense in connection with obtaining, attempting to <br />obtain, or performing a public (federal, state, or local) transaction or <br />contract under a public transaction; violation of federal or state an+itrust <br />statutes or commission of embezzlement, theft, forgery, bribery, falsification <br />or destruction of records, moking false statements, or receiving stolen <br />property: <br />(c) Are not presently indicted for or otherwise criminally or civilly charged by a <br />governmental entity (federal, state, or 10CCII) with commission of any of the <br />offenses enumerated in paragraph (4) (b) of this certification; and <br />(d) Have not within a three-year period preceding this application had one or <br />more public transaction (federal, state, or local) terminated for cause or <br />default. <br />Where the Applicant is unable to certify to any of the statements in this <br />certification, he or she shall attach an explanation to this application. <br />Initials
