Promptly remedy its acts or omissions and/or repay CITY all amounts duo to CITY as a result of
<br />EMPLOYER's violation, For any such failures ar viofations, CiTY shall also have the right at Its
<br />sole discretion to either: (l) dlscuntinuo program support until such Chno as EMPLOYER fulfills its
<br />obligations or remedies all violations of this Agreement or prior agreements; and/or (2,) coEloct
<br />outstanding amounts as determined by CITY' duo to CITY by offsetting or dobiting from au1ront
<br />claims or lnvoicea, If after thirty (30) days' written notico EMPLOYER has failed to repay same or a
<br />repayment schedule has 'not boon matte; and/or (3) terminate this Agreement in accordance with
<br />Section 1,5,
<br />10, EMPLOYER certifies that no member of the Qualified Participant's Imrnodlate family is engaged to
<br />an administrative capacity for the EMPLOYER or will directly supervise the Qualified Participant,
<br />?Or the purpose of this Agreement, immediate family is defined as spouse, children, parents,
<br />grandpparents, grandchildren, brothers, sistera or person beating :the •same -relationship' to the
<br />Quallf ed Participant's spouse, per 20 CPR 683,200,
<br />11, EMPLOYER assures that Sub rant funds will not he used to assist, promote or deter u.nlan

<br />12, Services and activities provided under this Agreement wilt be administered by or under the
<br />suporvlsion Of the EMPLOYER,
<br />13, No relative by blood, adoption or marriage. of the EMPLOYER may be trained undor this

<br />15, Conditions of employment or b"lning are appropriate and reasonable with regard to the type of
<br />work, the geographical region, and the profioloncy of the trainee.
<br />16. OJT Training will not be for any occupation Which reoqquirea We than six weeks of training
<br />according to the Specific Vocational Preparation Table (SVP Code).
<br />17. OJT Training wilt, to the maximum extent practicable, be consistent with every fndividual's fullest
<br />capabilities and lead to employment possibilities,
<br />18, The OJ'I` Training will, to the maximurr, extent feasible, contribute to Ilse occupational development
<br />or upward mobility of Individual participants,
<br />19. OJT 'Training will be in accordance with the training plan, which plan incarparatea documentation
<br />that must be completed by EMPLOYER before end of the Agreement.
<br />20,'sDot and **SVP code books will be used to determine length of OJT Training period, The training
<br />time may not be longer Chan the SVP Code allows; however, contractors are encouraged to negotiate
<br />shorter training periods whenever applicable,
<br />21, Qualified Participants shall not nurnber more than 40% of the EMPLOYERS work force,
<br />22, All payments/reimbursements matte by CITY to EMPLOYE, R must be, exclusive of any and all
<br />EMPLOYER fringe benefits, paid holidays, paid slcle days and overtime compensation,
<br />23, EMPLOYER must keep an accurate and up-to-date time shoot for the Qualified PArticipant.
<br />24 payroll records, time and attendance rocords and job duties retained on file by the participating
<br />EMPLOYER for each Qualified Participant are subject to review,
