holiday with supervisor and Department Head approval. Such holiday time is referred to <br /> as an "impact holiday". If the employee cannot take their holiday off before or after the <br /> regular scheduled holiday off, the employee shall bank the hours of their regular workday <br /> (nine (9)or ten (10)hours) as holiday leave to be used at a later date with the supervisor's <br /> approval. <br /> 9.7 All holiday benefits may not be carried over from one (1) calendar year to the next, with <br /> the exception of floating holidays earned as set forth in Section 9.8(C)(5). <br /> 9.8 Mandatory Holiday Closure <br /> A. Effective upon adoption of this MOU, City Hall and all other City departments <br /> (with the exception of the Police Department, Santa Ana Zoo,and select employees <br /> in Fleet Services Division) shall be closed for a mandatory winter holiday closure <br /> each year during the term of this MOU. <br /> B. Dates of Closure <br /> City Hall will be closed on the days between December 24 (except for years when <br /> December 24 falls on a Wednesday in which case City Hall will be closed starting <br /> on December 25)and January I each year.An employee regularly assigned to work <br /> on one(1)or more days during this time period shall use accrued paid leave (as set <br /> forth in Section 9.8(C))for their regularly scheduled hours for each day they would <br /> otherwise have been scheduled to work. <br /> During this time period, per Section 9.1 December 24 (except if it falls on a <br /> Wednesday in which case December 26 is the holiday),December 25, and January <br /> 1 (or the days these holidays are observed) are City holidays. <br /> C. Additional Days Off During a Closure <br /> 1. Employees will need to choose from the options in this subsection to cover <br /> any additional regularly scheduled work days which are not City observed <br /> holidays. <br /> 2. Employees may use any of the following accrued leaves they have available <br /> to cover any additional day(s)off which may be required by the closure: <br /> • Vacation <br /> • Compensatory Time Off <br /> • Impact Holiday Leave <br /> • Floating Holiday <br /> 3. Employees are not permitted to use sick leave for a holiday closure day <br /> unless they produce a physician's certification for each day reported as sick <br /> leave.
