(2) Domestic Preference for Procurements <br /> Recipient should,to the greatest extent practicable,provide a preference for the purchase, <br /> acquisition, or use of goods,products, or materials produced in the United States.This includes,but is not <br /> Iimited to iron, aluminum, steel,cement, and other manufactured products. <br /> For purposes of this clause: <br /> Produced in the United States means,for iron and steel products,that all manufacturing <br /> processes,from the initial melting stage through the application of coatings,occurred in the United States. <br /> Manufactured products mean items and construction materials composed in whole or in part of <br /> non-ferrous metals such as aluminum;plastics and polymer-based products such as polyvinyl chloride <br /> pipe; aggregates such as concrete; glass, including optical fiber; and lumber. <br /> W. Termination for Cause and Convenience—Should recipient fail for any reason to comply <br /> with the contractual obligations of this agreement within the time specified by this Agreement,the CITY <br /> reserves the right to terminate the Agreement,reserving all rights under state and federal law. <br /> x, Contractual/Legal Remedies for Breach of Contract—Should recipient fail for any reason <br /> to comply with the contractual obligations of this Agreement and/or willfully,knowingly or negligently <br /> breach any term, condition or requirement of the agreement,City may impose sanctions including but not <br /> limited to damages(liquidated damages and or penalties)and/or any other remedy available pursuant to <br /> the Agreement of the laws then in effect. <br /> Y. Conflict of Interest--In the event a conflict of interest is identified, disciplinary action <br /> shall be determined and imposed based on the severity of the violation and may include,but is not limited <br /> to,written warnings, suspension,mandatory ethics training,reassignment of duties,or termination of <br /> employment. All disciplinary action taken/imposed,will be documented and handled in accordance with <br /> applicable federal, state and local employment laws. <br /> 3 <br />
