Your complete <br />documentation was received on December 1, 2025. <br />HCD reviewed the City's Notice of Exemption (Notice) and supporting documentation <br />pursuant to Section 400 of the Surplus Land Act Guidelines. As explained below, HCD <br />finds that the Property qualifies as "exempt surplus land" under Government Code section <br />54221, subdivision (f)(1)(B). <br />Analysis <br />As provided in Government Code section 54221, subdivision (f)(1)(13), "exempt surplus <br />land" includes "[s]urplus land that is less than one-half acre in area and is not contiguous <br />to land owned by a state or local agency that is used for open -space or low- and <br />moderate -income housing purposes." <br />According to the Notice, the Property is no longer necessary for the City's use and is less <br />than one-half acre (0.38 acres) in area. Additionally, the Property is not contiguous to land <br />owned by a state or local agency that is used for open space or low- and moderate - <br />income housing purposes. <br />On December 1, 2025, the City confirmed that Government Code section 54221, <br />subdivision (f)(2) does not apply to the Property and, therefore, a written notice of <br />availability for open -space purposes is not required. <br />SLA0002295 <br />
