Broadway has sat stagnant. Today, the City is considering a 100% operational <br /> conversion from a commercial office tower to 602 high-density residential units. A change of this magnitude requires <br /> more than an administrative "Addendum"; it requires the highest level of scrutiny to protect our neighborhoods, our <br /> schools, and our infrastructure. <br /> 1. The Requirement for a Supplemental EIR <br /> The 2004 EIR is obsolete. Pursuant to CEQA Guidelines Section 15162, a Supplemental EIR is legally required because <br /> this residential shift creates "new significant environmental effects" never contemplated two decades ago: <br /> • Schools & Parks: Unlike office space, 602 apartments will place an immediate, permanent demand on SAUSD <br /> enrollment and our local parkland capacity (French Park). <br /> • Updated Standards: The 2004 data fails to address current Vehicle Miles Traveled (VMT) standards and 2026 <br /> air quality baselines. <br /> • Sensitive Receptors: Residential use introduces "sensitive receptors" to the site 24/7, requiring entirely new <br /> noise and health impact analyses. <br /> 2. Financial Due Diligence & Public Protection <br /> To ensure that Santa Ana does not endure another 20 years of blight, the City must perform a thorough audit of the <br /> project's fiscal history. I urge the Commission and Council to: <br /> • Review historical records, including former Planning Manager Vince Fregoso's logs, to verify that construction <br /> capital is secured specifically for this site. <br /> • Require a robust performance bond as a condition of approval to guarantee project completion. <br /> 3. Demand for Transparency <br /> I am not asking to block progress; instead I demand that the City proceed with its "eyes wide open." Using a 22-year-old <br /> EIR to bypass public review deprives Santa Ana residents of their right to understand the true impacts of this project. <br /> request a formal written response for the administrative record regarding: <br /> 1. The legal justification for using an Addendum for a total land-use conversion. <br /> 2. The specific analysis of impacts on SAUSD enrollment. <br /> 3. The application of SB 743 (VMT) to this new residential entitlement. <br /> Thank you for your commitment to a transparent and legally sound planning process. <br /> 1 <br />
