1-1 In addition to the general purposes listed in section 41-1, the specific purposes of <br /> this article are to: <br /> M Establish regulations for smoke shops, as defined in 41-152.6.1 of this Code. <br /> Establish reasonable and uniform regulations that will reduce possible <br /> adverse secondary effects that smoke shops may have upon the residents of <br /> the city and preserve the integrity of existing commercial and residential areas <br /> of the city, which are in close proximity to such commercial areas. <br /> Sec. 41-2409. - Permitted zones and locations. <br /> La) Smoke shops maybe located on parcels in the C1, C1-MD, C2, C4, C5, or C-SM <br /> zoning districts subject to the issuance of a conditional use permit. <br /> M No smoke shop shall be located within one thousand (1 ,000)feet of another <br /> smoke shop, as measured from the primary entrance of the smoke shop to <br /> the primary entrance of the nearest smoke shop. <br /> No smoke shop shall be located on a parcel located within one thousand <br /> (1,000) feet, as measured from the primary entrance of the smoke shop to <br /> the outermost boundary of the nearest parcel line whereon any of the <br /> following is located: <br /> i. A public park, playground, recreational area including a trail <br /> that is immediately adjacent to a public park, or youth facility, <br /> including, but not limited to, a boys and girls club, nursery <br /> school, preschool, or day care facility; <br /> ii. A school (K-12)as defined by Section 11362.768 of the Health <br /> and Safety Code; or <br /> iii. An alcohol or other drug abuse recovery or treatment facility. <br /> No smoke shop shall be located on a parcel located within five hundred <br /> (500)feet of a property zoned or used for residential purposes, as measured <br /> from the primary entrance of the smoke shop to the outermost boundary of <br /> the nearest parcel line of the property zoned or used for residential <br /> purposes. <br /> No smoke shop shall be permitted within a building or tenant space where <br /> any storefront, signage, or pedestrian entrance is oriented toward or visible <br /> from the public right-of-way of an arterial street, as defined and designated <br /> in the Mobility Element of the City's General Plan. <br /> Ordinance No. NS-#### <br /> Page 7 of 17 <br /> City Council 21 — 16 3/3/2026 <br />
