SANTA ANA REZONE PROJECT <br />INITIAL STUDY/MITIGATED NEGATIVE DECLARATION <br />implementation of this mitigation would reduce potential impacts related to human remains to a less <br />than significant level. <br />Tribal Cultural Resources <br />Would the project cause a substantial adverse change in the significance of a Tribal Cultural <br />Resource, defined in Public Resources Code Section 21074 as either a site, feature, place, cultural <br />landscape that is geographically defined in terms of the size and scope of the landscape, sacred <br />place, or object with cultural value to a California Native American Tribe, and that is: <br />d) Listed or eligible for listing in the California Register of Historical Resources, or in a <br />local register of historical resources as defined in Public Resources Code Section <br />5020.1(k), or <br />Less than significant impact with mitigation incorporated. A review of the CRHR, local registers <br />of historic resources, the SCCIC records search, and the NAHC SLF search results, and subsequent <br />Tribal representative outreach failed to identify any listed or eligible for listing TCRs that may be <br />adversely affected by the proposed project. Should any undiscovered TCRs be encountered during <br />project construction, implementation of MM CUL-1 and MM CUL-2 would ensure that undiscovered <br />TCRs are not adversely affected by project -related construction activities. <br />e) A resource determined by the lead agency, in its discretion and supported by <br />substantial evidence, to be significant pursuant to criteria set forth in subdivision (c) <br />of Public Resources Code Section 5024.1. In applying the criteria set forth in <br />subdivision (c) of Public Resource Code Section 5024.1, the lead agency shall <br />consider the significance of the resource to a California Native American Tribe. <br />Less than significant impact with mitigation incorporated. Tribal consultation efforts conducted <br />by the City pursuant to Assembly Bill (AB) 52 and Senate Bill (SB) 18 to identify additional significant <br />TCRs meeting the criteria set forth in Public Resources Code Section 5024.1 (c) were initiated on <br />April 11, 2025, and letters were sent to each Tribe on the NAHC consultation list. Three Tribal <br />responses were received requesting to consult on the proposed project. <br />The Juaneno Band of Mission Indians Acjachemen Nation 84A consultation meeting was scheduled <br />on May 15, 2025, to discuss any concerns that the Tribe may have pertaining to the development of <br />the proposed project. The Tribe did not express any concerns about the implementation of the <br />project. Consultation concluded on May 15, 2025. <br />The Juaneno Band of Mission Indians Acjachemen Nation—Belardes requested to consult on May 21, <br />2025. On May 27, 2025, the Tribe requested to consult via email correspondence. The Tribe also <br />requested additional information pertaining to the extent of ground disturbance and a copy of the <br />California Historical Resources Information System (CHRIS) SCCIC record search results. This <br />information was provided to the Tribe on May 29, 2025, and June 11, 2025. The Tribe requested a <br />draft of the inadvertent discovery plan, when available, and that information was provided to the Tribe <br />on July 29, 2025.
