computing actual duty days. <br /> <br />Employees holding the position immediately subordinate to the vacant, full-time, <br />budgeted, higher-level position to be filled shall be given first consideration to said <br />position consistent with the operational needs of the department. When there is <br />more than one (1) employee holding the position immediately subordinate to the <br />vacant, full-time, budgeted, higher-level position to be filled, the most senior <br />employee holding one (1) of the immediately subordinate positions shall be <br />assigned to said position consistent with the operational needs of the department. <br /> <br />Non-permanent employees (probationary, part-time, seasonal, etc.) and employees <br />performing work above their regular class in a training capacity shall not be <br />assigned to a vacant, full-time, budgeted, higher-level position in accordance with <br />this section unless specifically authorized by the City Manager. <br /> <br />B. Compensation. <br />1. After an employee has served two (2) consecutive calendar weeks in a <br />vacant, full-time, budgeted, higher-level position, they shall be <br />compensated at the Temporary Upgrade Assignment Pay rate for each full <br />day that they are assigned to the higher-level position, retroactive to the first <br />st <br />(1) day of said assignment. <br />2. An employee serving in a Temporary Upgrade Assignment will be paid <br />within the pay range of the higher-level position. The employee will receive <br />the higher of: 1) the minimum step of the higher-level position or; 2) five <br />percent (5%) of base pay inclusive of assignment pays which the employee <br />is receiving. <br /> <br />3. An employee assigned to a vacant, full-time budgeted, higher-level position <br />not represented by this bargaining unit (e.g., a Sergeant temporarily <br />assigned to act as a Lieutenant) will receive the Temporary Upgrade Pay <br />described above, but will remain a member of this bargaining unit. <br /> <br />4. An employee assigned to a vacant, full-time, budgeted, higher-level <br />position will continue to be eligible for salary step increases in their regular <br />position. <br /> <br />The parties agree that to the extent permitted by law, Temporary Upgrade Assignment Pay <br />is special compensation and shall be reported pursuant to Title 2, CCR 571(a)(3) as <br />Temporary Upgrade Pay. This pay is only reportable to CalPERS as special compensation <br />for those who qualify as classic members as described by the Public Employees’ Pension <br />Reform Act of 2013 – PEPRA. This pay is not reportable as special compensation for <br />employees defined as “new members” under PEPRA. However, CalPERS ultimately <br />determines whether any form of compensation qualifies as special compensation. <br /> <br /> <br /> <br />17 <br /> <br />
