9, The obligations of the Franchise Hauler under this Acknowledgment shall apply <br /> notwithstanding any provision of the Franchise which may conflict herewith. <br /> 10. This Acknowledgment may be enforced by the City by tiny available legal means.In ally <br /> enforcement action by the City, the burden of proof shall be oil the Franchise Hauler to demonstrate <br /> compliance herewith. <br /> 11. This Acknowledgment shall be in full force anti effect and shall be legally binding upon <br /> the City and Franchise Hauler from the date hereof and shall continue in full force kind effect until the <br /> earlier of(i)the end of(lie term of the Franchise or(ii)the end of the Term of the WISE Agreement. <br /> 12. The Laity and Franchise Hauler agree that the County shall be an express third-party <br /> beneficiary of this Acknowledgment, and shall be entitled to independently enforce the obligations of <br /> the Franchise Hauler €ereunder. There shall be no additional third-party benehciarieS under this <br /> Acknowledgement. <br /> 13, The Franchise Hauler agrees to assist the County in verifying tonnage collected by the <br /> Franchise Hauler and providing infonnation required by the County, The Franchise Hauler will provide <br /> upon request refuse tonnage collected within the County, and outside tho County (if relevant to <br /> confirming tonnage origination), separated by jurisdiction, by load type (residential, commercial, roll- <br /> offbox,etc.),and by Ricility to which it was delivered(specify which landfill or transfer station). Hauler <br /> will provide customer service levels and route lists.
