If an active nest(one containing eggs, nestlings, or dependent <br /> fledglings) is found., an avoidance buffer shall be determined and demarcated by a qualified <br /> biologist using flagging and stakes or construction fencing. The size of the buffer shall be <br /> sufficient to avoid direct impacts to the nest, eggs,young, and adults, and would depend upon the <br /> species and the proposed work activity. No work activity shall occur within the buffer until the <br /> Biologist confirms that the nest is no longer active. Construction persomiel shall be instructed on <br /> the sensitivity of the area. If Project activities must occur within the buffer,they shall be conducted <br /> at the discretion and under the supervision of the biologist. The qualified biologist will record the <br /> results of the recommended protective measures described above to document compliance with <br /> applicable State and federal laws pertaining to protection of native birds.
