ENRIQUEZ radioed to SAPD Dispatch that they had a suspect at gunpoint. GRAHAM ordered GUILLEN several times to put his hands up, but GUILLEN did not immediately comply. After several commands, GUILLEN put his hands up. GRAHAM then ordered GUILLEN to get on the ground. Again, GUILLEN did not immediately comply. He got down on his knees but continued to look back and forth, as if he was looking for a place to escape. GRAHAM continued to order GUILLEN to get all the way on the ground. After several commands, GUILLEN finally lay down on his stomach with his head facing GRAHAM. GUILLEN was lying on the ground on the north side of the pickup truck that was parked in the backyard. GRAHAM ordered GUILLEN to look away from him and put his face all the way on the ground. However, GUILLEN kept his head up off of the ground and continued to look around him. GRAHAM believed GUILLEN was looking for a way to escape. GUILLEN then began to push his upper body off the ground, as if he was going to get up to escape. GRAHAM ordered him to stay on the ground. GRAHAM decided he had to climb over the chain link gate to take GUILLEN into custody. He holstered his pistol and began climbing the approximate seven foot tall chain link gate. As GRAHAM was climbing over the gate, GUILLEN got up and ran east between the south wall of the backyard and the south side of the pickup truck. GRAHAM jumped over the gate and landed in the backyard on the north side of the pickup truck. GRAHAM ran east along the north side of the pickup truck in an attempt to cut off GUILLEN.
