As he did so, ALMANZA slammed the driver’s door of the Jeep closed. ALMANZA moved north and took cover behind the front of the Jeep. ENRIQUEZ noticed that as ALMANZA ran to the front of the Jeep, he maintained his hands close to his chest. ALMANZA maintained his arms in the “chicken winged” position that ENRIQUEZ had previously observed. This observation caused ENRIQUEZ to believe that ALMANZA was still in possession of a firearm. ENRIQUEZ yelled to ALMANZA, “Hey, don’t make me do this.” Since ALMANZA closed the driver’s door of the Jeep, there was now a clear and unobstructed view along the driver’s side of the Jeep.
