403. Provisions ApplicabIe to the ]Entire Proj ec L
<br />403.1 Use in Accordance with Redevelopment Plan. The Developer
<br />covenants and agrees to devote, use, operate, and maintain the Site and the Project in accordance
<br />with the Grant Deed, the Regulatory Agreement, and this Agreement. All uses conducted on the
<br />Site, including, without limitation, all activities undertaken by the Developer pursuant to this
<br />Agreement, shall conform to the Redevelopment Plan, all applicable provisions of the City'
<br />Municipal Code, any and all laws, rules, and regulations applicable to the Site and the Project,
<br />and the recorded documents pertaining to and running with the Site.
<br />403.2 Nondis crimin tion Covenants. The Developer covenants by and for
<br />itself and any successors in interest that, except as otherwise provided or permitted by law, there
<br />shall be no discrimination against or segregation of, any person or group of persons on account
<br />of any basis listed in subdivision a or d of Section 12955 of the Govemment. Code, as those
<br />bases are defined in Sections 12926, 12926.1, subdivision m and paragraph 1 of subdivision
<br />(p) of Section 12955, and Section 12955.2 of the Government Code, in the sale, lease, sublease,
<br />transfer, use, occupancy, tenure, or enjoyment of the Site, nor shall the grantee or any person
<br />el aiming under or through him or her, establish or permit any practice or practices of
<br />discrimination or segregation with reference to the selection, location, number* use or occupancy
<br />of tenants, lessees, subtenants, sublessees, or vendees in the Site. The foregoing covenants shall
<br />run with the land.
<br />Except as otherwise provided or permitted by law, the Developer shall refrain
<br />from restricting the rental, sale or lease of the Site or any portion thereof) on any of the bases
<br />listed above in this Section 403.. All such deeds, leases or contracts shall contain or be subject
<br />to substantially the following nond i s rimin ation or nonsegre ga tion clauses:
<br />(a) In deeds: "The grantee herein covenants by and for himself or
<br />herself, his or her heirs, executors, administrators, and assigns, and all persons claiming under or
<br />through therm, that there skull be no discrimination against or segregation of, any person or group
<br />of persons on account o f any basis listed i n subdivision a or d of Section 12955 of the
<br />Government Code, as those bases are defined in Sections 12926, 12926. 1, subdivision m and
<br />paragraph 1 of subdivision p of Section 12955, and Section 12955.2 of the Govemment Code,
<br />in the sale lease, sublease, transfer, use, occupancy, tenure, or enjoyment of the premises herein
<br />conveyed, nor shall the grantee or any person claiming under or through him or bier, establish r
<br />permit any practice or practices of discrimination or segregation with reference to the selection,
<br />location, number, use or occupancy of tenants, lessees, subtenants, sublesse. s, or vendees in the
<br />premixes herein conveyed. The foregoing covenants shall run with the land."
