Chanter 6? <br />Fireworks. The denial of an application may be appealed to the uniform code appeals <br />board. <br />SECTION 75: That section 14-76 of the Santa Ana Municipal Code is hereby amended <br />such that it reads as follows (new language underlined, deleted language in strikeout for tracking <br />purposes only): <br />Sec. 14-76. Exceptions. <br />Nothing in this article shall be construed to prohibit the use of fireworks by <br />railroads or other transportation agencies for signal purposes or illumination or the sale <br />or use of blank cartridges for a show or theater performance, or for signal <br />purposes in athletics or sports, or for use by military organizations. <br />SECTION 76: That section 14-78 of the Santa Ana Municipal Code is hereby amended <br />such that it reads as follows (new language underlined, deleted language in strikeout for tracking <br />purposes only): <br />Sec. 14-78. Prohibited areas. <br />No persons shall sell, store, display, or discharge any fireworks of any type in <br />any public oil or gasoline station, or on any premises where gasoline or other <br />+r#lammable liquids are stored or dispensed. No person shall sell, store, display, or <br />discharge any fireworks of any type in any permanent structure, nor within forty (40) feet <br />of the same, except that any purchaser may discharge fireworks in conformance with <br />these regulations ?-•?*4..;., +.-,e.,+•• f:.,e ?'??? fee+ in front of his own residence. <br />SECTION 77: If any section, subsection, sentence, clause, phrase, or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the validity of the remaining portions of this <br />ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, phrase or portion thereof <br />irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, <br />or portions be declared invalid or unconstitutional. <br />SECTION 78: Neither the adoption of this ordinance nor the repeal hereby of any ordinance <br />shall in any manner affect the prosecution for violation or ordinances, which violations were <br />committed prior to the effective date hereof, nor be construed as affecting any of the provisions of <br />such ordinance relating to the collection of any such license or penalty or the penal provision <br />applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu <br />thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and <br />obligations there under appertaining shall continue in full force and effect. <br />Ordinance No. NS-XXXX <br />7C /? _?7 Page 49 of 50
