Approve Conditional Use Permit No. 96-42 as conditioned and adopt the <br />findings as submitted by at aff. <br /> Approve Conditional Use Permit No. 96-42 as conditioned and adopt the <br /> findings as submitted by at aff. <br /> Mr. Yenglin presented the staff report. <br /> Commissioner Mondo requested clarification for several conditions of <br /> approval. <br /> Mr. George Andrade, applicant, expressed his concern regarding the conditions <br /> of approval. He specifically mentionedconditions related to parking lot <br /> upgrades, reatxictione for persona under 21, trash enclosure, and his <br /> requirement to employ a security guard. <br /> Commissioner Oliver noted that he did not support requiring Mr. Andrade to <br /> employ a security guard, however he recommended a functional alarm system at <br /> to be operational at all times. <br /> MOTION: Oliver SECOND: Molly <br /> After further discussion, the Commission modified the conditions of approval <br /> not requiring the applicant to provide a trash enclosure, to review the <br /> conditional use permit in 90 days, and not to require the applicant to employ <br /> a security guard. However, the Commission informed the applicant if the <br /> crime rate increased, a security guard may be required in the future. <br /> MOTION: Oliver SECOND: Molly <br /> AYES: Brown, Dovghty, Oliver, Mondo, Pedroza, and Segura <br /> NOES: None <br /> ABSENT: Nalle <br />3. ORAL. COMMUNICATIONS - COlB.ffiNTS FROM THE PUBLIC. <br /> (For ®atters sot previously listed oa the Aaendal <br /> Mr. James Kendrick, local resident, commented that he had noticed an increase <br /> in noncomplying signs on Main Street. In addition, Mr. Kendrick commented <br /> that he would like staff and the Commission to possibly develop a sign <br /> ordinance requiring all signs to advertise in English. <br /> Commissioner Mondo indicated that he also believed Main Street aignage was <br /> increasing and out of control. <br /> Ma. Uptegraff responded that she would be happy to have code enforcement <br /> officers inform the Commission on their current projects. In addition, she <br /> mentioned that there were six persons assigned to aignage. <br /> Mr. Adams informed the Commission that staff had no authority to regulate the <br /> content on billboards. However, a study session could be placed on an <br /> afternoon Planning Commission session to address signage. <br /> Commissioner Oliver commented that he did not want to devote too much time <br /> addressing language issues regarding signage and he believed it would be a <br /> mistake to try and require English only signage. <br /> Ma. Uptegraff commented that requiring English only signage may contradict <br /> first amendment rights. <br />4. EBCUSE OF ABSENCES. <br /> Commissioner Oliver moved to approve the absence of Commissioner Na11e. The <br /> motion was seconded by Commissioner Segura and passed unanimously. <br />5.
