EXHIBIT J <br />SCHEDULE OF PERFORMANCE <br />A. GENERAL <br />Submittal of Agreement. Developer shall execute and submit Five (5) days prior to <br />the Loan Agreement (the "Agreement") to Agency/City for Agency/City consideration and <br />consideration and action at a public meeting. action on the Agreement. <br />2. Agency Approval/Disapproval of Exceptions. <br />Agency/City shall provide Developer with written notification <br />of Agency/City's approval or disapproval of the exception(s) <br />set forth in the preliminary report for the Property. <br />3. Insurance. Developer shall furnish or cause to be furnished <br />appropriate certificates of insurance and/or endorsements to <br />Agency/City which meet all requirements of the Agreement. <br />B. PROJECT FINANCING <br />Submission of Evidence of Financing. Developer shall submit <br />to Agency/City evidence of financing for the Project as set <br />forth in Section 311, et seq. of the Agreement. <br />2. Receipt of All Funding Commitments Necessary to Complete <br />Construction of the Improvements. Developer shall use its best <br />and good faith efforts to secure irrevocable funding <br />commitments from CDLAC, TCAC, and Senior Lender, which <br />when combined with the Loans shall equal no less than the total <br />cost to construct the Improvements, as set forth in the approved <br />Project Budget. Developer shall submit such commitments to <br />Agency/City for review. <br />Within thirty (30) days after <br />the later to occur of <br />Agency/City's receipt of <br />legible copies of the <br />documents underlying the <br />Exceptions or date of the <br />Agreement. <br />As a Condition Precedent to <br />disbursement of any portion of <br />the loans, but in no event later <br />than December 31, 2011. <br />Not later than sixty (60) days <br />after allocation of tax exempt <br />bond financing for the Project <br />by CDLAC, but in no event <br />later than October 31, 2011. <br />Not later than sixty (60) days <br />after allocation of tax exempt <br />bond financing for the Project <br />by CDLAC and allocation of <br />Tax Credits to the Project by <br />TCAC, but in no event later <br />than October 31, 2011. <br />3. Approval of Developer's Evidence of Financing. Agency/City Not later than twenty (20) <br />shall approve, conditionally approve, or disapprove business days after receipt of a <br />Developer's evidence of financing as required by the complete submittal from <br />Agreement.
