MEA►�ORI�#NDUM <br />To: City Manager <br />— Date <br />From: Director of Public Works <br />August 11. 1971 <br />Subject: AGREEMENT FOR PEDESTRIAN OVERPASS ON FIRST STREET AT SADDLEBACK INN <br />This Office has been contacted by Mr. Bruce Gelker of Saddleback Inn Santa Ana, <br />Incorporated regarding the possibility of the City giving permission to his company to <br />construct a pedestrian overpass spanning First Street between Lyon and Mabury <br />Street in order to connect Saddleback Inn facilities lying on both sides of <br />First Street. Research by the City Attorney's office disclosed that such a <br />facility could be permitted by the City through the use of an encroachment <br />agreement. Such an agreement has been drafted by the City Attorney's depart- <br />ment in conjunction with the Public Works Department and is being submitted <br />for Council review and approval. <br />Crossings such as contemplated by the Saddleback Inn are not without precedents <br />in Southern California. Similar crossings exist at the Pen and Quill Hotel in <br />Manhattan Beach, and at the El Cortez Hotel in San Diego. The agreement between <br />the E1 Cortez Hotel and the City of San Diego is very similar to the agreement <br />submitted here. <br />Renderings of various concepts which Mr. Gelker's architect has developed for <br />this structure will be available at the Council meeting of August 16. The <br />Department of Public Works has no objection to the construction of this facility <br />provided that all the terms of the agreement are met. In actuality the removal <br />from the surface of First Street of the anticipated heavy pedestrian movement <br />between the two Saddleback Inn facilities would benefit the City by relieving <br />possible traffic congestion. <br />Recommendation. Should the Council approve the desirability of having an over- <br />head structure crossing a public right of way between private properties, it is <br />recommended that the attached Encroachment Agreement be approved. <br />�� <br />Ronald E.
