mitigated to levels of insignificance. Mitigation measures contained in the FEIR were designed to <br />minimize short -term construction air quality impacts. The additional incremental increase resulting <br />from the proposed modification to the project must also be considered significant and adverse when <br />added to the existing non - attainment levels of the South Coast Air Basin. However, the incremental <br />change between the 2005 project and the proposed project is de minimis. The City has adopted a <br />Statement of Overriding Considerations related to air quality impacts based on the original analysis in <br />the FEIR and the FEIR remains adequate and complete. <br />d) Would the project expose sensitive receptors to substantial pollutant concentrations? (No Substantial <br />Change from Previous Analysis) <br />The FEIR identified air quality impacts related to sensitive receptors with project implementation. No <br />changes have occurred in this area from the previous analysis; therefore, the FEIR remains adequate <br />and complete. <br />e) Would the project create objectionable odors affecting a substantial number of people? (No <br />Substantial Change from Previous Analysis) <br />The FEIR identified air quality impacts related to the release of objectionable odors due to project <br />implementation. The modifications to the condominium component will not result in any new or <br />objectionable odors beyond those previously analyzed. No changes have occurred related to the <br />creation of objectionable odors; therefore, the FEIR remains adequate and complete for this topic. <br />IV. Biological Resources <br />a) Would the project have a substantial adverse impact, either directly or through habitat modifications, <br />on any species identified as a candidate, sensitive or special status species in local or regional plans, <br />policies or regulations or by the California Department of Fish and Game or U. S. Fish and Wildlife <br />Services? <br />b) Would the project have a substantial adverse impact on any riparian habitat or other sensitive natural <br />community identified in local or regional plans, policies and regulations or by the California <br />Department of Fish and Game or U. S. Fish and Wildlife Service? <br />c) Would the project adversely impact federally protected wetlands (including, but not limited to, marsh, <br />vernal pool, coastal, etc.) either individually or in combination with the known or probable impacts of <br />other activities through direct removal, filling, hydrological interruption, or other means? <br />d) Would the project interfere with the movement of any native resident or migratory fish or wildlife <br />species or with established native resident or migratory wildlife corridors or impede the use of native <br />wildlife nursery sites. <br />e) Would the project conflict with any local policies or ordinances protecting biological resources, such <br />as tree preservation policy or ordinance? <br />fi Conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community <br />Conservation Plan, or other approved local, regional, or state habitat conservation plan? <br />The FEIR Initial Study determined that, because the project site did not include biological resources, <br />no impact would occur and no further analysis was required. The project is located in a substantially <br />built -out area of Santa Ana, and the site was previously disturbed with grading and construction. There <br />have been no changes related to biological resources.
