Ih -0l C L l <br />INSURANCE ON FILE <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />ih -of-?.c? t <br />CLERK OF COUNCIL <br />DATE -5-19-11 <br />A-2010-057-02 <br /> SECOND AMENDMENT TO CONTRACTOR <br /> AGREEMENT INCORPORATING COMMUNITY <br /> DEVELOPMENT BLOCK GRANT REQUIREMENTS <br /> 14 A- <br />THIS SECOND AMENDMENT TO AGREEMENT is entered into on the Pt, <br /> t <br />day o U=14.2011, by and between SimplexGrinnell LP ("Contractor") and the City of <br /> Santa Ana, a charter city and municipal corporation organized and existing under the <br /> Constitution and laws of the State of California ("City"). <br /> <br />U RECITALS: <br /> A. The parties entered into that certain Contractor Agreement Incorporating <br />v Community Development Block Grant Requirements, dated April 5, 2010 (A#2010-057 - <br /> hereinafter referred to as "said Agreement") by which Contractor has provided special <br /> skill and knowledge in the field of the provision and installation of a fire alarm system in <br /> order to gain compliance with the Technical Assistance Review Report (TARR) issued by <br /> and through the State of California Employment Development Department's Equal <br /> Employment Opportunity Office. <br />B. The parties amended said Agreement on November 1, 2010 to extend its Term. <br />C. In accordance with the terms and conditions of said Agreement, the parties <br />wish to include additional obligations and exhibits to said Agreement. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />-FirstAmendment to Agreement, the parties agree as follows: <br />1. Section 7, CONTRACTOR'S OBLIGATIONS, shall be amended to include two new <br />sections as follows: <br />Q. Compliance with Davis Bacon. Contractor agrees that it will comply with the <br />regulations set forth in Exhibit D, attached hereto and incorporated herein. <br />R. Section 3 of the Housing and Urban Development Act of 1968. Contractor <br />agrees that it will comply with the regulations set forth in Section 3 of the Housing <br />and Urban Development Act of 1968, as amended, 12 U.S.C.1701u, as set forth in <br />Exhibit E, attached hereto and incorporated herein, and include said requirements in <br />every subcontract subject to compliance with said regulations. Contractor further <br />agrees to comply with HUD's regulations in 24 CFR Part 135. <br />2. Section 3, TERM, shall be amended to extend the termination date to June 30, 2011. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall <br />remain in full force and effect.
