ARTICLE VII <br />DEFINITIONS <br />7.1 Definitions <br />Whenever the following ternis are used in the Plan, with the first letter capitalized, they <br />shall have the meanings specified below, <br />"Act" means California Government Code, <br />"Anniversary Date" means July 1, <br />"Beneficiary" means the person, persons, trust or trusts designated by a Member, or, in <br />the absence of a designation, entitled by will or the laws of descent and distribution, to receive <br />the benefit, if any, specified under this Plan if the Member dies and means the Member's <br />executor or administrator if no other beneficiary is designated and able to act under the <br />circumstances. <br />"Benefit Final Pay" means the salary increase granted on July 1, 2009 and/or January 1, <br />2010, or the Union Pay Premium, which was not recognized by CalPERS for purposes of <br />computing Final Pay. <br />"Benefit Service" means the total credited CalPERS service credit earned with the <br />Employer, not to exceed thirty (30) years if classified as a safety employee. <br />"CalPERS" means the California Public Employees' Retirement System. <br />"CalPERS Benefit Factor" means the age factor determined by the Member's age at <br />retirement based on the CalPERS Local Miscellaneous 2.7% at 55 table or the CalPERS, Local <br />Safety 3% at 50 table, whichever is applicable to the Member's employment classification with <br />the Employer. <br />N13 1:790,120.2 29 <br />
