C. Nepotism: By signing this Agreement the Contractor certifies that it shall not hire
<br />or permit the hiring of any person in a position funded under this Agreement if a member of the
<br />person's immediate family is employed in an administrative capacity. by the Contractor. For the
<br />purpose of this Agreement, the term's immediate family's means spouse (common law or
<br />otherwise), child, mother, father, brother, sister, brother -in -law, sister -in -law, son -in -law, daughter -in-
<br />law, mother -in -law, father -in -law, aunt, uncle, niece, nephew, step - parent, step - child, or such other
<br />relationship which would give rise to a substantial appearance of impropriety if the person were to be
<br />hired by the Contractor. The term's administrative capacity's means persons who have overall
<br />administrative responsibility for a program, including but not limited to selection, hiring, or
<br />supervisory responsibilities.
<br />D. Drug Free Workplace Compliance: By signing this Agreement the Contractor hereby
<br />warrants and certifies that it shall comply with California Drug -Free Workplace Act of 1990 (Cal.
<br />Gov. Code Section 8350 et seq.), as amended, including provision of the requisite certification as
<br />set forth therein; and the federal Drug -Free Workplace Act of 1998, including its implementing
<br />regulations (29CFR Part 98, commencing with 98.600)
<br />E. Nondiscrimination and Affirmative Action: By signing this Agreement the Contractor
<br />hereby certifies that it shall conduct not discriminate against any employee or applicant for
<br />employment because of race religious creed, color, national origin, ancestry, physical handicap,
<br />medical condition, marital status or sex. The Contractor will take affirmative action to assure that
<br />applicants are employed, and that employees are treated during their employment, without regard to
<br />their race, religious creed, color, national origin, ancestry, physical handicap, medical condition,
<br />marital status or sex.
<br />XXII --- PUBLICITY
<br />No funds provided under this agreement shall be used for publicity or propaganda
<br />purposes, for the preparation, distribution or use of any kit, pamphlet, booklet, publication, radio,
