a benefit to which that person is entitled under the provisions of the WIA or WIA Regulations <br />because such person has filed a complaint, has instituted or caused to be instituted any proceeding <br />under or related to the Act, has testified or is about to testify in any such proceeding or investigation, <br />or has provided information or assisted in any investigation. <br />F. Contractor shall permit the Directorate of Civil Rights (or a representative) access to its <br />premises, participants, employees, books, and papers should the need arise during a complaint <br />investigation. <br />XXVI -- DISPUTE RESOLUTION AND BREACH <br />A. Dispute: Contractor agrees to use administrative processes and negotiation in <br />attempting to resolve disputes arising from this Agreement. Contractor shall continue performance <br />of the Agreement activities during such dispute and shall immediately submit written request for <br />informal review and consultation to the SBWIB, INC. Administration. <br />If the dispute is not resolved within thirty (30) days of such request, SBWIB, Inc. through its agent, <br />shall review the disputed matter and, after consultation with the SBWIB, Inc. Administration and the <br />Contractor, reach a resolution. Contractor shall be issued a decision in writing that shall bind all <br />parties. <br />Contractor shall be afforded an opportunity to appeal and to offer evidence in support of its <br />appeal. Pending final decision of an appeal, Contractor shall proceed with the performance of the <br />Agreement. Upon final disposition, Contractor shall comply with SBWIB, Inc.'s decision. <br />B. Breach: In the event any party fails to perform, in whole or in part, any promise, <br />covenant, or agreement herein, or should any representation made by it be untrue, any aggrieved <br />party may avail itself of all rights and remedies, at law or equity, in the courts of law. Said rights and <br />remedies are cumulative of those provided for herein with respect to termination, if any, except that <br />in no event shall any party recover more than once, suffer a penalty or forfeiture, or be unjustly <br />compensated. <br />24 <br />
