INSURANCE NOT REQUIRED <br />WORK MAY PROCEED <br />CLERK OF COUNCIL <br />N-201 1-150 <br />DATA ? ?? 9 201, <br />MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE CITY OF SANTA ANA <br />AND THE SANTA ANA WORK CENTER/WORKFORCE INVESTMENT BOARD <br />This Memorandum of Understanding, dated October ?, 201 1, between the City of Santa Ana <br />(hereinafter "City"), and the Santa Ana Work Center /Workforce Investment Board (hereinafter <br />"WORK Center"). <br />RECITALS <br />1. The WORK Center desires to continue to lease space at the Santa Ana Regional <br />Transportation Center ("SARTC"), to provide its programs and services to the public. <br />2. The parties desire to set forth their agreement regarding the WORK Center's lease of <br />space at the SARTC. <br />TERM: <br />The Term of this Agreement will commence July 1, 2010 and continue through June 30, 2012. <br />TERMS AND CONDITIONS: <br />1. City shall allow WORK Center to occupy Suites 200 and 220 (7419 sq. ft.) within the <br />Santa Ana Regional Transportation Center (SARTC), located at 1000 East Santa Ana <br />Boulevard, Santa Ana, CA 92701. <br />2. City shall provide janitorial service and all utilities, except telephones and security <br />equipment . <br />Payment. <br />a. The monthly user fee for the term from July 1, 2010 through June 30, 201 1, is <br />$14,425.36. The rate has been adjusted to incorporate the 1.8% CPI increase applied <br />to all SARTC tenants for FY 2010/11. WORK Center has during this term, paid a <br />monthly user fee of $14,170.29. The parties agree that WORK Center will within <br />thirty days of execution of this MOU, reimburse City for unpaid FY 10/1 1 user fees <br />in the amount of $3,060.84 ($14,425.36 - $14,170.29 = $255.07/month x 12). <br />b. The monthly user fee for the term from July 1, 2011 through June 30, 2012, is <br />$14,612.89. The rate has been adjusted to incorporate the 1.3% CPI increase applied <br />to all SARTC tenants for FY 2011/12. WORK Center has through the <br />commencement of this MOU paid a monthly user fee of $14,170.29. The parties <br />agree that WORK Center will within thirty days of execution of this MOU, reimburse <br />City for unpaid FY 11/12 user fees in the amount of $442.60/month ($14,612.89 - <br />$14,170.29 = $442.60) for each month of FY 1 1 /12 the initial user fee has been paid. <br />c.
