In providing fire services, OCFA hereby is authorized to and may enforce applicable CITY <br />codes and ordinances, collect and retain any and all Fire Prevention or Miscellaneous User fees <br />(excluding paramedic user fees) as determined by OCFA, and file any claims or actions on behalf of CITY <br />to recover and retain amounts for emergency and hazardous materials responses. <br />2. The OCFA Fire Chief hereby is designated as Fire Chief of CITY. <br />3. Personnel and equipment routinely assigned to provide services under this Agreement shall <br />be assigned to Battalion 9. The Battalion Chief of Battalion 9 will exercise day -to -day operational <br />responsibility within the CITY. <br />4. On activation of the CITY's Emergency Operations Center (EOC), the individuals designated <br />by the CITY Manager and the Division Chief shall be detailed to assist in EOC operations and release of <br />local resources may occur only after their evaluation of local conditions. <br />V.
