A-2011-180 <br />IrJ URANGE NO '-ECURIEF <br />VIORK W' <br />LERF; <br />DATF? 7-0- <br />Amendment to Agreement between <br />Verizon Wireless and the City of Santa Ana <br />for Wireless Services <br />THIS AMENDMENT TO AGREEMENT, made and entered into this 18th day of July, <br />2011, by and between Cellco Partnership dba Verizon Wireless, a Delaware general partnership <br />(hereinafter "Verizon"), and the City of Santa Ana, a charter city and municipal corporation <br />organized and existing under the Constitution and laws of the State of California (hereinafter <br />"City") <br />Reference: <br />The State of California Wireless Contract, hereafter referred to as "CWC", contract number: 1S- <br />05-58-02, expired October 2010. <br />The State of California WSCA Participating Addendum Master Price Contract, Contract #7-10-70- <br />16, hereafter referred to as "California WSCA Contract", commenced October 2010 and <br />supersedes the CWC. <br />The City of Santa Ana, California, hereafter referred to as the City. <br />RECITALS <br />A. Verizon and the State of California entered into the CWC in 2005 by which Verizon has <br />offered wireless data services for the State and for participating local agencies; and <br />B. The term of the CWC expired and Verizon and the State of California entered into the <br />California WSCA Contract to replace the CWC which permits state and local agencies to <br />engage in cooperative purchasing, similar to what they did under the CWC; and <br />C. Verizon has provided wireless data services to the City, on the terms and conditions set <br />forth in the CWC; and <br />D. Additional City departments have requested wireless data communications accounts to <br />support mobile computing systems within the City. <br />E. City has determined that Verizon continues to be the provider that best meets its <br />wireless data requirements and the rates set forth in the California WSCA Contract are <br />the most competitive rates available to the City. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. Scope of Services <br />1.1. Verizon Wireless will provide to the City wireless data communications services and <br />equipment, including broadband wireless access and wireless voice with text and data services.
