REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />APRIL 2, 2012 <br />TITLE: <br />ACQUISITION SETTLEMENT <br />AGREEMENT FOR BRISTOL STREET <br />CORRIDOR (PROJECT NO. 081700) <br />CITY MANAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />APPROVED <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 151 Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Authorize the City Manager and Clerk of the Council to execute the attached acquisition <br />settlement agreement with Abel Torres in the amount of $22,000 subject to nonsubstantive <br />changes approved by the City Manager and City Attorney. <br />DISCUSSION <br />On February 2, 2009, the City Council approved the purchase agreement between the City and <br />Mary Jane Draganza as Trustee of the Draganza Family Trust. The agreement was to purchase <br />the property located at 517 North Bristol as part of the second phase of the Bristol Street <br />Widening Project between Third Street and Civic Center Drive. <br />As part of the relocation process, the tenant, Abel Torres, is entitled to goodwill benefits. Staff <br />has been negotiating with Mr. Torres and has reached a comprehensive settlement agreement. <br />The compensation amount is the based on a loss -of- goodwill study prepared by an appraiser <br />licensed by the State of California. <br />ENVIRONMENTAL IMPACT <br />In accordance with the California Environmental Quality Act, the proposed project has been <br />determined to be adequately evaluated in the previously prepared Environmental Impact <br />Report/Environmental Impact Assessment EIR No. 89 -01 approved by City Council in 1990. <br />25D -1 <br />
