Chapter 1 O, Article XII of the Santa Ana Municipal Code <br />May 21 , 2012 <br />Page 2 <br />Rackauckas has also met with Chief of Police Paul Walters and Mayor Pro Tem Alvarez to <br />provide additional information regarding the county ordinance and other cities' recent adoptions of <br />similar sex offender proximity ordinances, as well as information regarding sex crimes occurring <br />against children within Orange County. <br />PUBLIC SAFETY COMMITTEE REVIEW <br />On April 24th, 2012, the Santa Ana Public Safety Committee considered whether the City of <br />Santa Ana's sex offender ordinance should be revised, as recommended by District Attorney <br />Rackauckas. After discussion by Committee members and staff, which included a reference to a <br />recent sexual offense committed against a minor that occurred in the City of Tustin's library (see <br />attached District Attorney Press Release, posted March 13, 2012), a motion was made and <br />unanimously passed to recommend the City Council consider adopting a revised ordinance that <br />contains provisions similar to the county ordinance. The Committee also recommended that <br />KidWorks, the Orange County Children's Therapeutic Arts Center, and the Main Library be <br />included in the list of children's facilities. <br />The revised ordinance recommended by the Public Safety Committee would redefine "sex <br />offender" to include all persons who are required to register when the underlying offense involved <br />a child or children, including but not limited to child pornography, or any person required to <br />register pursuant to Penal Code sections 290, et seq., similar to the county ordinance. <br />In addition, the revised ordinance would (1) retain the current three-hundred (300) foot proximity <br />prohibition for the specific intent of observing children or if the offender returns after being told to <br />leave, (2) delete the loitering alone language, (3) add the .county's presence prohibition inside the <br />designated children's facilities, and (4) add penalties and severability clauses. <br />Lastly, as was also recommended by the Public Safety Committee, the revised ordinance adds <br />KidWorks, the Orange County Therapeutic Arts Center, and the Main Library to the list of <br />children's facilities. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action. <br />???- <br />Paul Walters <br />Chief of Police <br />Police Department <br />Attachments: 1.
