REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />JUNE 4, 2012 <br />CLERK OF COUNCIL USE ONLY: <br />TITLE: APPROVED <br />ACQUISITION SETTLEMENT ❑ As Recommended <br />AGREEMENT FOR BRISTOL STREET El Amended <br />El O Or rdinance on 15t Reading <br />CORRIDOR (PROJECT NO. 081700) ❑ Ordinance on 2 "d Reading <br />NON - GENERAL FUND ❑ Implementing Resolution <br />❑ Set Public Hearing For_ <br />CONTINUED TO <br />FILE NUMBER <br />CITY MANA ER <br />RECOMMENDED ACTION <br />Authorize the City Manager and Clerk of the Council to execute the attached acquisition <br />settlement agreement with Mr. Chris Yoh, Luv -N- Donuts located at 410 North Bristol Unit A, in <br />the amount of $26,000 subject to nonsubstantive changes approved by the City Manager and <br />City Attorney. <br />DISCUSSION <br />On March 6, 2006, the City Council approved the cooperative agreement between the City and <br />the Orange County Transportation Authority to fund Bristol Street improvements from Warner <br />Avenue to Seventeenth Street. The first phase of the project, between Pine Street and <br />McFadden Avenue, is complete. Public Works is acquiring property for the second phase of the <br />project, between Third Street and Civic Center Drive, and expects to complete the acquisition <br />process by mid -July 2012 and start construction in fall 2012. <br />To accommodate the widening for the second phase, partial acquisition, cut and reface of <br />property located at 410 North Bristol are required (Exhibit 1). This partial acquisition also <br />necessitates the relocation of the Luv -N- Donuts business to an interior unit in the same building. <br />In addition, the business will suffer a loss of goodwill during the cut and reface of the building. <br />Compensation in the amount of $26,000 is the appraised value prepared by an appraiser <br />licensed by the State of California. Mr. Yoh has agreed to the compensation amount as a <br />comprehensive settlement. <br />ENVIRONMENTAL IMPACT <br />In accordance with the California Environmental Quality Act, the proposed project has been <br />determined to be adequately evaluated in the previously prepared Environmental Impact <br />Report/Environmental Impact Assessment EIR No. 89 -01 approved by City Council in 1990. <br />25H -1 <br />
