(Page 23 of 61) <br /> <br />83-430391 <br />NOW, THEREFORE, in consideration of the facts recited <br />above and the mutual convenants, terms, conditions and <br />restrictions contained herein, and pursuant to SS815 and 816 of <br />the California Civil Code, Grantor hereby voluntarily grants <br />and conveys to Grantee an Architectural Facade Easement in <br />gross in perpetuity over the property of the nature and <br />character and to the extent hereinafter set forth. <br />1. Grantor convenants to do or refrain from doing upon <br />the property each of the following; <br />Without the written permission of Grantee, no <br />construction, alteration or remodeling shall be undertaken or <br />permitted to be undertaken on the property which would affect <br />either the exterior surface or otherwise alter the facade or <br />appearance of the presently existing improvements on the <br />property, or which would adversely affect the structural <br />soundness of the improvements.
